VenziMedia may process your request and transmit it to independent home-improvement contractors, installers, dealers, manufacturers, franchises, advertisers, call centers, or other service providers. VenziMedia and OurHomeHelpers.com are not home-improvement contractors and do not perform, supervise, warrant, or guarantee home-improvement work.

3. Independent Service Providers

Businesses contacting you through OurHomeHelpers.com are independent third parties. VenziMedia does not guarantee their:

• Licensing, insurance, or bonding;
• Qualifications, safety, or compliance with law;
• Pricing, availability, or workmanship;
• Warranties or financing options.

You are responsible for independently investigating and selecting any provider. Any contract for home-improvement work is between you and the selected provider—not VenziMedia.

4. Your Representations

By submitting information, you represent that:

• You control or are authorized to use the telephone number and email address submitted;
• You are genuinely seeking information about the identified service;
• You are not submitting another person’s information without authorization;

7. Promotions

Discounts, financing, savings claims, warranties, installation timelines, and promotional offers may be subject to provider participation, eligibility requirements, geographic limits, minimum purchases, credit approval, and additional terms. VenziMedia does not provide financing and does not guarantee eligibility for any promotion.

8. Prohibited Conduct

You may not:

• Submit false or unauthorized information or impersonate another person;
• Interfere with website security or introduce malicious code;
• Scrape or harvest website information or generate fake/duplicate requests;
• Use the website to build a competing database or violate applicable law.

9. Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OURHOMEHELPERS.COM AND THE OURHOMEHELPERS SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” VENZIMEDIA DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, QUALITY, AND RESULTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VENZIMEDIA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OURHOMEHELPERS.COM, COMMUNICATIONS FROM SERVICE PROVIDERS, WORK PERFORMED BY A PROVIDER, CONTRACTS WITH PROVIDERS, OR UNAUTHORIZED DATA ACCESS. VENZIMEDIA’S TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO VENZIMEDIA DURING THE SIX MONTHS BEFORE THE CLAIM OR $100.

11. Arbitration and Class-Action Waiver

Except for qualifying small-claims matters and claims that cannot lawfully be arbitrated, disputes arising from OurHomeHelpers.com will be resolved through binding individual arbitration under the Federal Arbitration Act and the applicable Consumer Arbitration Rules of the American Arbitration Association.

You and VenziMedia agree to bring claims only in an individual capacity and not through a class, collective, consolidated, representative, or private-attorney-general proceeding. Before initiating arbitration, the complaining party must submit an individualized written Notice of Dispute and allow 60 days for informal resolution.

You may opt out of arbitration by submitting a signed written notice within 30 days after first accepting these Terms.

12. Governing Law

Except where applicable law requires otherwise, these Terms are governed by California law. Court proceedings not subject to arbitration must be brought in the state or federal courts located in Alameda County, California.
